Variance Appeal Agreement

A Variance Appeal Agreement is a legal document that formalizes the process through which a property owner seeks a deviation from specific zoning laws or regulations set by a local government. Such variances are typically requested when compliance with the existing zoning requirements would cause unnecessary hardship to the property owner.

The Variance Appeal Agreement outlines the details of the requested variance, including the specific zoning regulation from which the property owner wishes to depart, the reasons for the request, and any supporting evidence demonstrating the need for the variance. This agreement often includes a commitment to comply with any conditions imposed by the zoning board or administrative body upon granting the variance.

For example, if a homeowner wants to build a structure that exceeds the height limit designated by local zoning ordinances, they would file a Variance Appeal Agreement explaining their reasoning, such as unique topography or a lack of available building sites. The local zoning board would then review the agreement and may hold a public hearing to gather input from the community before making a decision.
