Damages
Overview: Damages refer to a monetary compensation awarded to a party in a legal proceeding as a remedy for a loss or injury suffered due to the unlawful action or negligence of another party. The primary aim of damages is to restore the injured party to the position they would have been in had the wrongful act not occurred.
Types of Damages:

Compensatory Damages: These are intended to compensate the victim for actual losses incurred. They can be further divided into:
- Economic Damages: Quantifiable monetary losses, such as medical expenses, lost wages, and property damage.
- Non-Economic Damages: Compensation for intangible losses, such as pain and suffering, emotional distress, and loss of companionship.

Punitive Damages: Awarded in addition to compensatory damages, punitive damages aim to punish the wrongdoer for particularly egregious conduct and deter similar actions in the future. They are not based on the actual losses suffered by the plaintiff but rather on the defendant’s behavior.

Nominal Damages: A small sum awarded when a legal wrong has occurred, but no actual economic harm can be demonstrated. This type serves to recognize that a violation has taken place.

Liquidated Damages: Pre-determined damages specified in a contract, which parties agree upon in advance as compensation for breach of contract. These are enforceable as long as they are not deemed excessive or punitive.
Examples: In a personal injury case, if a plaintiff is injured in a car accident due to a defendant’s negligence, they may be awarded compensatory damages for their medical bills and lost wages, as well as non-economic damages for the pain and suffering they endured. If the defendant’s actions were particularly reckless, punitive damages might also be awarded to discourage such behavior in the future. In a breach of contract situation, a seller might include a liquidated damages clause stating that if the buyer fails to complete the purchase, they must pay a specified amount as compensation.
