Wrongful Dismissal Mediation
Wrongful dismissal mediation is a process used to resolve disputes arising from an employee’s termination that is claimed to be unlawful or unjust. This form of alternative dispute resolution allows both the employer and the employee to discuss the circumstances surrounding the dismissal in a neutral setting with the help of a mediator.
In wrongful dismissal cases, the employee typically argues that their termination violated employment laws, contractual terms, or company policies. The mediation process seeks to facilitate a dialogue between the parties to reach a mutually agreeable solution, which may include financial compensation, reinstatement, or clarification of the circumstances of the dismissal.
During mediation, the mediator does not make binding decisions but instead helps the parties communicate effectively and explore options for resolution. The process is generally less formal and more flexible than litigation, allowing for creative solutions that meet the needs of both parties. It often results in quicker resolutions and can preserve professional relationships that might otherwise be damaged by a lengthy court battle.
