Construction Dispute Adjudication

Construction Dispute Adjudication is a formal process used to resolve disagreements arising during the construction of a project. This mechanism is designed to provide a quick and efficient resolution to disputes, allowing work to continue without significant delays.

In practice, Construction Dispute Adjudication involves the appointment of an adjudicator, who is usually an experienced professional with expertise in construction law and practices. The adjudicator hears both parties’ arguments and reviews the evidence presented. Based on this information, the adjudicator issues a binding decision that both parties must adhere to, at least until the dispute is resolved through further legal proceedings, such as arbitration or court.

For example, if a contractor claims that a project owner has not made timely payments for work completed, the contractor may initiate Construction Dispute Adjudication. The adjudicator would review the contract terms, payment schedules, and any relevant communications to determine whether the contractor’s claims are valid and to what extent.

This process is particularly beneficial in the construction industry, where time is often critical, as it helps minimize disruptions and financial losses associated with longer litigation processes.
