A Conservator Account is a financial account established to manage and safeguard the assets of an individual who is deemed unable to manage their own affairs due to incapacity or disability. This account is typically created by a court when a conservatorship is established, appointing a conservator to oversee the financial matters of the individual, known as the ward.

The Conservator Account serves several important functions:

  1. Asset Management: The conservator is responsible for managing the ward’s assets, which may include cash, investments, real estate, and personal property. The conservator must act in the best interests of the ward, ensuring that the assets are preserved and utilized effectively.

  2. Record Keeping: The conservator is required to maintain accurate records of all transactions involving the conservator account. This includes income received, expenses paid, and any distributions made to or on behalf of the ward.

  3. Court Oversight: Transactions in a Conservator Account are typically subject to court oversight. The conservator must often file periodic reports with the court detailing the account’s activity, providing transparency and accountability in managing the ward’s assets.

  4. Use of Funds: Funds from the Conservator Account can be used for the ward’s living expenses, medical costs, and other necessary expenditures, ensuring that the ward’s needs are met while protecting their financial interests.

For example, if a conservator is appointed for an elderly individual who can no longer manage their finances due to dementia, the conservator would create a Conservator Account to receive the individual’s Social Security payments, pay their bills, and manage any investments or property they own.

In Texas, the establishment and management of a Conservator Account are governed by the Texas Estates Code, which outlines the responsibilities of the conservator and the requirements for court approval of certain transactions.
