Wrongful Termination Mediation

Wrongful termination mediation is a process in which an impartial third party, known as a mediator, assists employees and employers in resolving disputes arising from alleged wrongful termination. Wrongful termination refers to the unlawful dismissal of an employee from their job, which may violate employment contracts, labor laws, or public policy.

In the mediation process, both parties present their perspectives regarding the termination. The mediator facilitates communication, helps clarify issues, and encourages negotiation to reach a mutually acceptable resolution. Mediation is typically a less formal, confidential, and quicker alternative to litigation, allowing parties to explore settlement options without the pressure of a courtroom environment.

For example, if an employee claims they were fired for reporting illegal activities (a whistleblower claim), mediation can provide a platform for both the employee and employer to discuss the circumstances surrounding the termination. They may negotiate terms such as financial compensation, reinstatement, or other remedies that could resolve the dispute without resorting to a lawsuit.
